Death From By Falling In Pit: People often have to take precautions while walking on the road. Otherwise it wouldn’t take long for an accident to happen. It has been seen many times that many people have lost their lives due to potholes on the road. Such cases are seen quite often, especially during the monsoon season. Just a few days ago, a woman died after falling into a manhole in Mumbai.
It has been seen many times that construction work is going on on the road and potholes have been made. No separate security arrangements would have been made for them. The general public also passes by it. Because of which it has been seen many times that people fall into those pits. And they even die. In such a situation, who is responsible for the death after falling into the pit? Let us tell you.
Government has responsibility
It is the responsibility of the government to build roads and maintain them. Under Article 21 of the Constitution of India, all Indian citizens have the right to life and liberty. Right to life means the right to live with dignity and the government is responsible to protect this right. The entire responsibility of roads comes under the civic body of the government.

In such a situation, if there is a pothole on the road, then the responsibility for it also falls on the road civic body. If someone dies after falling into a pit, then the civic body is responsible for this too. That is to say, death occurs by falling into a pothole on the road. So in such a situation the government is responsible.

A case may be registered
There are potholes on the roads, the roads are dug up, drains or manholes are not covered. All this is considered negligence on the part of the civic body. If any construction work is being done somewhere on the road, there is a pothole there or the road itself is damaged. And someone dies after falling into that pit on the road. Then a case can be filed under death caused by negligence only on one body. Recently, a woman in Mumbai fell into a manhole during the rainy season, due to which she died. In this case, a case of death due to negligence has been registered against Brihanmumbai Municipal Corporation and a contractor.
